General Terms and Conditions
1 Scope and Supplier
The General Terms and Conditions are valid for all purchases, which are done via online shop on www.charity-kalender.de, or by email. The product offer is only intended for customer aged 18 or older. Our deliveries, performances and offers are strictly done based on these Terms and Conditions, even if this is not explicitly mentioned. The use of own Terms and Conditions of a customer, which contradict our Terms of Conditions, are not accepted.
2 Conclusion of Contract
The presentation of the good in our online shop are no binding offer on finalizing a contract but a non binding invitation to order products in the online shop. By clicking the button “Order” a binding offer is done by the customer. After receiving the purchase offer you will get an automatically generated email, in which we confirm the reception of the order and provide with the payment details. The contract is concluded with the payment and the resulting shipment of the goods.
3 Prices, Payment Terms and Shipment
The mentioned prices contain the German sales tax. The payment for international customers is done by PayPal. The shipment will be done within three work days after receiving the money.
4 Cancellation Policy
Private customers have the right to revoke this contract within fourteen days without stating the reason. The cancellation term starts on the day of receiving the goods. To make use of the right to revoke the contract you need to inform us with an evident message (e.g. by regular mail or e-mail). The cancellation term is kept when sending this message before expiry of the term. When revoking this contract we will have to repay the amount within fourteen days after receiving your cancellation message. The full amount will be repaid via PayPal. We can refuse and hold back the payment until the goods have reached us or you have sent us a proof to have shipped the goods our way. You have to send the goods back to us on your own shipment costs within fourteen days after sending the message to cancel the contract. The cancellation term is kept when sending the goods before expiry of the term. The customer carries the costs for the shipment back to us and is responsible for shipping in an adequate packaging unit. The customer is only liable for a loss of value if the goods were not used in an appropriate way.
5 Transportation Damage
Report obvious transportation damages immediately to the deliverer and inform us about the mistake. A failure of a complaint has no effect on the legal warranty rights but you help us making our own claims towards the transportation company or transportation insurance.
6 Data Protection
Personal data of the customers will be treated confidently according to the data protection regulations.
7 Final Terms
Other clauses of these General Terms and Conditions remain valid in case that one or several terms should be invalid. Only German law is applicable for our contracts, excluding the terms of the United Nations Convention on Contrats for the International Sale of Goods (CISG). Place of Court is Amtsgericht Gütersloh.
